Terms of Service
Please read these Terms of Service ("Terms") carefully before using the YouWork platform. These Terms form a binding agreement between you and YouWork LLC ("YouWork", "we", "us").
1. Acceptance of terms
By creating an account or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you are accepting on behalf of a business entity, you represent that you have authority to bind that entity.
2. The Service
YouWork is a business management platform for trades contractors. It includes tools for lead management, estimating, job scheduling, invoicing, payment collection, and customer communication, accessible at app.youwork.pro.
We reserve the right to modify, add, or remove features at any time. We'll give reasonable notice for changes that materially reduce functionality.
3. Accounts & eligibility
You must be at least 18 years old and legally capable of entering a binding contract to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.
You agree to provide accurate, current, and complete information during registration and to keep it updated. Accounts created with false information may be suspended or terminated.
4. Free trial
New accounts receive a 14-day free trial with no credit card required. At the end of the trial period your account will be downgraded or suspended unless you add a payment method and select a plan. We reserve the right to modify or discontinue free trial offers at any time.
5. Billing & subscriptions
Plans and pricing
Paid plans are billed on a monthly or annual basis at the rates listed on the Pricing page. Current plan pricing:
- Starter — $79/month or $790/year
- Pro — $199/month or $1,990/year
- Master — $399/month or $3,990/year
- Enterprise — custom pricing, contact sales
All prices are in US dollars. We may change pricing with at least 30 days' notice to active subscribers.
Payment
Payments are processed by Stripe, Inc. By providing a payment method you authorize us to charge the applicable fees on each billing date. Subscriptions renew automatically unless cancelled before the renewal date.
Refunds
We do not offer refunds for partial billing periods. If you cancel, your access continues until the end of the current paid period. Annual plan subscribers may request a full refund within 7 days of the annual renewal date, provided they have not used the Service during that renewal period. Contact us at support@youwork.pro to request a refund.
Failed payments
If a payment fails, we will retry the charge and notify you by email. Accounts with unpaid balances older than 14 days may be suspended until payment is resolved.
6. Acceptable use
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Transmit spam, unsolicited messages, or deceptive communications to your customers.
- Upload content that is unlawful, defamatory, obscene, or infringes third-party rights.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Reverse-engineer, scrape, or create derivative works from the platform without our written consent.
- Use the Service on behalf of a competing software business to evaluate or replicate its features.
We reserve the right to suspend or terminate accounts that violate these rules, with or without notice, at our reasonable discretion.
7. Your data
You retain ownership of all business data — jobs, customers, estimates, invoices, and other content — that you create in the platform ("Customer Data"). You grant YouWork a limited license to store, process, and display Customer Data solely to provide the Service to you.
You are responsible for the accuracy of your data and for ensuring you have appropriate rights to any content you upload, including customer information. You bear responsibility for complying with applicable privacy laws in your own communications with your customers.
Upon account cancellation or termination, you may export your data for 30 days before it is deleted. See our Privacy Policy for full data retention details.
8. Intellectual property
The YouWork name, logo, platform design, code, and all associated intellectual property are owned by YouWork LLC and protected by applicable law. Nothing in these Terms transfers ownership of YouWork IP to you.
You may not use the YouWork name or branding in any way that implies partnership, endorsement, or affiliation without our prior written consent.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
YouWork is a business management tool. We are not responsible for the business decisions you make based on information generated by the platform.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, YOUWORK'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID YOUWORK IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
IN NO EVENT WILL YOUWORK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR LOST DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Indemnification
You agree to indemnify and hold harmless YouWork LLC, its officers, employees, and agents from any claim, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your Customer Data, or your violation of these Terms.
12. Termination
You may cancel your account at any time through your account settings or by contacting us. We may suspend or terminate your account immediately for violations of these Terms, non-payment, or conduct we believe poses a risk to other users or the platform.
Sections 7 (Your data — post-cancellation export window), 8 (IP), 9 (Disclaimers), 10 (Liability), 11 (Indemnification), and 13 (Disputes) survive termination.
13. Disputes & governing law
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict of law provisions.
Any dispute arising from these Terms or the Service will be resolved by binding individual arbitration under the rules of the American Arbitration Association. Class action and jury trial rights are waived. The arbitration will take place in the State of Wisconsin.
14. Changes to these terms
We may update these Terms from time to time. We'll post the revised version here with an updated date. For material changes, we'll notify active subscribers by email at least 14 days before the change takes effect. Continued use after the effective date constitutes acceptance.
15. SMS communications
Messages from YouWork to you
By providing a mobile phone number during registration, you consent to receive transactional SMS messages from YouWork, including account alerts, security notifications, and platform updates. Standard message and data rates may apply. Message frequency varies. To opt out, reply STOP to any message from us. For help, reply HELP.
Messages you send to your customers
The YouWork platform enables you to send SMS messages to your customers — for example, job confirmations, appointment reminders, invoice notifications, and review requests. By using this feature, you agree to:
- Obtain express written consent from each recipient before sending any marketing or promotional SMS messages, as required by the Telephone Consumer Protection Act (TCPA) and all applicable regulations.
- Honor all opt-out requests — including STOP replies — promptly and without exception, and maintain records of consent for each recipient.
- Not send messages to any recipient who has previously opted out or revoked consent.
- Ensure all messages clearly identify your business as the sender.
- Comply with all applicable federal and state laws governing commercial text message communications.
You bear sole responsibility for the content, timing, and legality of messages sent to your customers through the platform. YouWork is not liable for your failure to obtain proper consent or to comply with applicable SMS regulations. Violations of this section may result in immediate suspension of SMS sending privileges or termination of your account.
Message and data rates may apply for messages received by your customers. Carrier delivery is not guaranteed.
